Terms & Conditions
Version 1.0
1. About us and these terms
UK Home Designs is a trading name of UK Designs Ltd, a company registered in England and Wales (Company No. 16800740), registered office 64 Southwark Bridge Road, London SE1 0AS ("we", "us", "our"). These terms apply to every service you buy from us ("you", "your").
By placing an order you accept these terms. Please read them before you buy. Nothing in these terms affects your statutory rights as a consumer.
2. How we provide our services
All of our services are provided remotely and desk-based. We do not visit your property for any service unless we agree otherwise in writing for an extra fee.
Each service is a separate, fixed-price product. You only receive what is listed for the service you have bought. Anything not listed is outside the service and is chargeable (see clause 9).
3. One project per service
Planning Drawings & Application, the Building Regulations Technical Pack and Structural Calculations & Beam Overlay each cover one standard project: a single-storey extension, a loft conversion, or an internal reconfiguration.
Work beyond one standard project may be subject to additional charges at our hourly rate (clause 9), including but not limited to: an additional storey; wrap-around, combined or multiple extensions; loft conversions over 50 cubic metres or otherwise outside permitted development; and any project combining more than one of the above.
4. Your measured survey
You must supply an accurate measured survey of your property, prepared by you or a surveyor you appoint. We do not carry out measured surveys. We can suggest local surveyors, but any surveyor is appointed and paid by you, and we are not responsible for their work.
Our drawings rely entirely on the survey you supply. We do not check it on site. You are responsible for its accuracy. If drawings must be redrawn because of an error or omission in your survey, or because of information you gave us that was wrong or incomplete, that work is chargeable at our hourly rate (clause 9).
5. Design changes and amendments
Our design services are prepared from your brief and your measured survey. No rounds of amendments are included in any price. Any change you ask for after we have issued drawings is chargeable at our hourly rate (clause 9).
If we have made an error in our own work, we will correct it free of charge.
6. Planning Drawings & Application
This service includes existing and proposed floor plans and elevations, location and block plans, and preparation and submission of one planning application (or Lawful Development Certificate or prior approval application) to your council.
Council application fees are payable by you directly to the council. Once the application is submitted, it is handed over to you: you deal with the council and the case officer. We do not act as your planning agent after submission.
Not included, and chargeable if needed: further drawings or information requested by the council; design and access or heritage statements; work for conservation areas, listed buildings or other designated land; reports such as ecology, flood risk, tree or highways; resubmissions and appeals.
We cannot guarantee that any application will be validated or approved. The council's decision is outside our control.
7. Building Regulations Technical Pack, Building Notice and structural calculations
The Building Regulations Technical Pack provides drawings and specification notes to Building Notice level. It does not include a full plans submission, drainage layouts, or mechanical, electrical or ventilation design. Further information requested by Building Control, your builder or any approved inspector is chargeable.
The Building Notice Submission covers preparing and serving one Building Notice. Council or approved inspector fees are payable by you.
Structural calculations are prepared by an independent qualified structural engineer, who is not necessarily chartered. They are desk-based, using your survey and drawings and reasonable assumptions about the existing structure. No site inspection, opening-up or trial pits are carried out. Your builder and Building Control must check the assumptions on site. Any redesign needed because site conditions differ from those assumptions is chargeable.
8. Party Wall Notice and Builder Tender
The Party Wall Notice service covers preparing one notice under the Party Wall etc. Act 1996 for one adjoining owner, with an acknowledgement form. Serving the notice is your responsibility unless agreed otherwise. Party wall surveyors, awards and disputes are not included.
The Builder Tender service covers a schedule of works prepared from your drawings, issued by email to up to three local builders identified by us, with you copied in, and a standard form building contract for you to use. Builders are not vetted, approved or recommended by us. We do not guarantee that any builder will respond or quote. Any building contract is between you and your builder, and we are not responsible for any builder's work, conduct, prices or programme.
9. Additional work and our hourly rate
Any work outside the service you have bought, including the items in clauses 3 to 8, is charged at £150 per hour, with a minimum charge of three hours. We will tell you before any chargeable work starts, and it starts only once you have agreed and paid.
10. Planning Pre-Check
The Planning Pre-Check is a desk-based report using publicly available information and the details you provide. Its findings, consent route and cost range are indicative only and are not a guarantee of any council decision or build cost. It is for your use only.
11. Prices and payment
All prices are fixed and shown in full. Payment is taken in full when you order, by secure online payment. Work starts once payment is received and we have the information we need from you.
12. Your right to cancel
You may cancel within 14 days of your order. If you ask us to start work within those 14 days, you agree to pay for work done up to the point you cancel, and you lose the right to cancel once the service has been fully provided.
To cancel, email hello@ukhomedesigns.co.uk. Refunds are made within 14 days to the original payment method.
13. Your responsibilities
You must give us accurate, complete information and respond promptly. You are responsible for obtaining any consents your project needs, for checking your title deeds for restrictive covenants, and for any neighbour, party wall or build-over obligations.
14. Copyright
We own the copyright in all drawings and documents we produce. Once you have paid in full, you may use them for the one project at the address they were prepared for.
15. Our liability
We provide our services with reasonable care and skill. Our total liability to you for any service is limited to the price you paid for that service. We are not liable for losses that were not foreseeable, for business losses, or for losses caused by information you supplied, by a third party (including your surveyor, builder or the council), or by events outside our control.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
16. Complaints and governing law
If you are unhappy with our service, email hello@ukhomedesigns.co.uk and we will respond within 10 working days. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, except where the law of your home nation applies.
